Pertinent Procedural History and Plaintiff’s Claims On August 3, 2023, Plaintiff Carlton Mario Sims (“Plaintiff”), who is proceeding pro se, filed a First Amended Complaint under 42 U.S.C. § 1983 against Defendant California Department of Corrections and Rehabilitation Health Care Department Chief S. Gates (“Gates”). [Dkt. No. 8 at 3.] Plaintiff alleges that he received inadequate medical treatment after contracting COVID-19.
