Dkts. 10 (“Mot.”), 10-1 (“Margarian Decl.”). Defendant BMW Financial Services NA, LLC (“BMW”) opposes the Motion. Dkt. 16 (“Opp’n”). On September 18, 2024, the court found the matter appropriate for resolution without oral argument and vacated the hearing set for September 20, 2024. Dkt. 25; see Fed. R. Civ.
