(ECF No. 4.) Thirty days from that 19 date have now passed, and petitioner has not filed an IFP, or otherwise responded to the court’s 20 order. 21 IT IS HEREBY ORDERED that the Clerk of the Court is directed to assign this action to 22 a United States District Judge. 23 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See 24 Local Rule 110; Fed. R. Civ. P. 41(b). 25 These findings and recommendations are submitted to the United States District Judge 26 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days 27 after being served with these findings and recommendations, plaintiff may file written objections 28 with the court and serve a copy on all parties.
