19 Plaintiff, formerly a state prisoner proceeding pro se, brought this civil rights action 20 seeking relief under 42 U.S.C. § 1983. Plaintiff paid the filing fee. See 10/25/ docket entry 21 indicating same. The matter was referred to a United States Magistrate Judge pursuant to 28 22 U.S.C. § 636(b)(1)(B) and Local Rule 302. 23 The record indicates that Plaintiff has passed away. See ECF No. 32.
