16 Petitioner is a state prisoner proceeding pro se with a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. I. BACKGROUND On February 7, 2019, Petitioner was convicted by a jury in the Merced County Superior Court of three counts of first-degree robbery. (1 CT1 243–45.) On April 13, 2021, Petitioner was sentenced to an imprisonment term of sixty-four years to life. (2 CT 394.) On November 18, 2022, the California Court of Appeal, Fifth Appellate District affirmed the judgment. People v. Hernandez, No. F082679, 2022 WL 17076562 (Cal. Ct. App. Nov. 18, 2022).
