I. BACKGROUND

8 This case has been pending for several years and in the interest of brevity, the Court 9 highlights pertinent parts of the case background. 10 Plaintiff is in the business of chemical water treatment solutions for agricultural irrigation 11 and alleges that Defendant Mahoney, one of its former employees, launched Defendant 12 Agrigenix, LLC as a direct competitor to Plaintiff using Plaintiff’s confidential, proprietary, and 13 trade secret information. On April 18, 2018, Plaintiff filed this action against Defendant 14 Agrigenix and Mahoney alleging claims for trade secret misappropriation, false advertising, two 15 claims for breach of contract, two related claims for breach of the covenant of good faith and fair 16 dealing, intentional interference with prospective economic advantage, and unfair competition. 17 (Doc. 1.) Plaintiff filed the operative Second Amended Complaint on February 24, 2020, alleging 18 eight claims for relief, described more particularly below.
