Plaintiffs are the estate and successor-in-interest of Ronnie Price, who is deceased. Pending before the Court is the motion to dismiss Plaintiffs' third amended complaint filed by Defendants Lynch and Baughman. See ECF No. 130. The parties appeared for a hearing before the undersigned on April 24, 2024. At the hearing, the Court considered the parties' arguments and directed supplemental briefing on the following issues: (1) whether Plaintiffs have pleaded sufficient facts to establish the supervisory liability of Defendants Lynch and Baughman; and (2) whether the third amended complaint constitutes a "sham pleading."
