17 Proceeding without the assistance of counsel, plaintiff Kevin B. Johnson filed the instant action on August 3, 2022.1 After filing the complaint, plaintiff sought and was granted an extension of time to file an application to proceed in forma pauperis. (ECF Nos. 11, 13.) On October 25, 2022, plaintiff paid the filing fee and on December 27, 2022, the Clerk of Court issued summons for plaintiff to serve the defendants. (ECF No. 28.) On January 22, 2024, the court ordered plaintiff to show cause as to why defendants had not been served and why this case should not be dismissed for lack of prosecution. (ECF No. 58.)
