17 Plaintiff is proceeding pro se and in forma pauperis in this action filed pursuant to 42 18 U.S.C. § 1983. Plaintiff filed the instant action on July 29, 2024. On August 7, 2024, the Court 19 ordered Plaintiff to pay the $450.00 filing fee or submit a non-prisoner application to proceed in 20 forma pauperis by a prisoner within 30 days. (ECF No. 6.) Plaintiff failed to respond to the 21 Court’s order. Therefore, on October 1, 2024, the Court ordered Plaintiff to show cause why the 22 action should not be dismissed, without prejudice, for failure to prosecute and failure to comply 23 with a court order.
