Trial Court Opinion
UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF CALIFORNIA 9 LACEY SIVAK, Case Nos. 23-cv-05996-AMO (PR) Petitioner, 24-cv-02255-AMO (PR) 11 24-cv-02256-AMO (PR) v. 24-cv-02257-AMO (PR)
JUDGE SUNG, et al., 24-cv-02259-AMO (PR) Respondents. 24-cv-02937-AMO (PR) 14 24-cv-02938-AMO (PR)
ORDER OF DISMISSAL WITHOUT
PREJUDICE
Lacey Sivak, an Idaho state prisoner and frequent litigant, filed the above-captioned 18 actions, representing himself. In each case, the Court denied Sivak’s motion for leave to proceed 19 in forma pauperis (“IFP”) pursuant to 28 U.S.C. § 1915(g)1 because he has had three or more prior 20 dismissals, has failed to allege any specific imminent danger of serious physical injury at the time 21 he filed the action, and did not meet the standard for proceeding without payment of filing fees as 22 a “three-striker” who has had many prior lawsuits dismissed as frivolous. See Ray v. Lara, 31 23 F.4th 692, 697 (9th Cir. 2022)…
