On August 16, 2024, Defendant Target Corporation (“Target”) filed a motion to dismiss Plaintiff Alexander Panelli’s first amended complaint pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim and to strike certain class action allegations. (Doc. No. 36.) On September 20, 2024, Plaintiff filed a response in opposition to Defendant’s motion to dismiss. (Doc. No. 39.) On September 24, 2024, the Court took the matter under submission.
