Defendants move for summary judgment on the grounds that plaintiff failed to exhaust administrative remedies as to his claims against defendant R. Hart; defendants R. Hart and E. Ramirez did not retaliate against plaintiff by issuing rules violation reports against him; and defendants are entitled to qualified immunity. As discussed below, the Court recommends that the motion be denied in part and granted in part. II.
