18 This matter is before the Court on Defendant Costco Wholesale Corporation’s (“Costco”) Motion to Dismiss. (ECF No. 3.) Plaintiffs Lashawn Thomas and Domonae Scarbrough (collectively, “Plaintiffs”) oppose. (ECF No. 10.) Costco filed a reply. (ECF No. 11.) For the reasons set forth below, the Court GRANTS in part and DENIES in part Costco’s motion to dismiss. /// /// /// /// /// I. FACTUAL AND PROCEDURAL BACKGROUND Plaintiffs are two African-American women. (ECF No. 1 at 24.) On August 10, 2023, Plaintiffs went shopping at Costco and decided to use the self-checkout lane.
