19 I. Background Petitioner David Jimenez is a state prisoner proceeding with a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. His petition asserts a claim for ineffective assistance of counsel. Doc. 1 at 8. This matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. On July 24, 2024, the assigned magistrate judge issued findings and recommendations to abstain and dismiss the petition without prejudice under Younger v. Harris, 401 U.S. 37 (1971). Doc. 4.
