This order addresses two motions: the defendants’ Motion to Compel Arbitration and the plaintiff’s request for a preliminary injunction. In the underlying complaint, plaintiff Side, Inc. (“Side”) alleges that corporate defendant Official Partners New York, LLC (“Official Partners”), and individual defendants Tal and Oren Alexander (the “Alexanders”) (altogether, “the defendants”) breached the terms of the Amended and Restated Promissory Note and the Amended and Restated Security Agreement (the “Restated Agreements”).
