17 I. INTRODUCTION Plaintiff is a state prisoner, proceeding without counsel, with a civil rights action pursuant to 42 U.S.C. § 1983. Pending before the Court is defendants’ motion for summary judgment as to the second amended complaint (ECF No. 77), plaintiff’s motion for appointment of counsel (ECF No. 79) and defendants’ motion to strike plaintiff’s sur-reply. (ECF No. 87.)
