INTRODUCTION 14 Pending before the Court is Defendant City and County of San Francisco’s Motion to 15 Dismiss Plaintiff’s Second Amended Complaint pursuant to Federal Rule of Civil Procedure 16 12(b)(6). ECF No. 37. Plaintiff Zahir Naseri filed an Opposition (ECF No. 38) and Defendant 17 filed a Reply (ECF No. 39). The Court finds this matter suitable for disposition without oral 18 argument and VACATES the January 23, 2025 hearing. See Civ. L.R. 7-1(b). For the reasons 19 stated below, the Court GRANTS the motion.1 20 II.
