17 18 Pending before the Court is Defendant San Diego Unified Port District’s 19 (“SDUPD”) motion to dismiss Plaintiff’s Complaint pursuant to Fed. R. Civ. P. 12(b)(1) 20 and 12(b)(6). (Defendant’s Motion, ECF No. 5). Plaintiff filed a response in opposition 21 on August 30, 2024. (Plaintiff’s Opposition, ECF No. 8). Defendant SDUPD filed its 22 reply on September 13, 2024. (Defendant’s Reply, ECF No. 9). The Court found this 23 matter to be suitable for resolution without oral argument pursuant to Civil Local Rule 24 7.1(d)(1). (ECF No. 10).
