16 17 Xavier Buckhanan is proceeding pro se in this action, filed pursuant to Bivens v. Six 18 Unknown Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971) and the Federal Tort 19 Claims Act, 28 U.S.C. § 1267. The Court dismissed the action after finding Plaintiff failed to 20 prosecute the matter and failed to comply with the Court’s order. (Doc. 21.) Plaintiff now seeks 21 reconsideration of the dismissal pursuant to Rule 60(b), asserting “excusable neglect and 22 extraordinary circumstances” warrant relief. (Doc. 23 at 1.) For the reasons set forth below, the 23 motion for reconsideration is DENIED without prejudice. 24 I.
