16 17 I. Background Plaintiff Candace Smith (“Plaintiff”), proceeding pro se and in forma pauperis, filed this action on May 16, 2024. (Doc. 1.) On May 22, 2024, the Court issued its order granting Plaintiff’s application to proceed in forma pauperis. (Doc. 3.) On June 7, 2024, Defendants filed their motion to dismiss for lack of jurisdiction. (Doc. 4.) On June 26, 2024, District Judge Kirk E.
