Now pending before the Court is Defendants’ motion for summary judgment. ECF No. 35. Plaintiff has filed an opposition, ECF No. 38, and Defendants have filed a reply, ECF No. 40. Plaintiff has also filed a motion to strike. ECF No. 38 at 20-30. For the reasons set forth below, the Court DENIES Plaintiff’s motion to strike, ECF No. 38 at 20-30; DENIES Defendants’ motion for summary judgment, ECF No. 35; and sets a schedule for briefing the merits of Plaintiff’s claims. …
