On September 24, 2024, defendants filed a motion for summary judgment. On November 26, 2024, plaintiff was ordered to file an opposition or a statement of non-opposition to the pending motion and was informed that failure to file an opposition would result in a recommendation that this action be dismissed pursuant to Fed. R. Civ. P. 41(b). Plaintiff has not filed a response to the motion for summary judgment and the time for doing so has expired.
