See 28 U.S.C. § 636(b)(1). In the motion presently before the court, defendants move for dismissal of the case based on plaintiff’s failure to comply with court orders to respond to discovery requests. (ECF No. 69.) Defendants also request their attorney fees. For the reasons set forth below, the undersigned recommends that defendants’ motion be granted as to the request for terminating sanctions.
