18 19 20 Presently before the Court is Respondent’s Motion to Dismiss the Petition for Writ 21 of Mandate filed by Pacific Surgical Institute of Pain Management, Inc. (“Pacific 22 Surgical”). (ECF No. 8.) Pacific Surgical seeks mandamus relief concerning a dispute 23 over reimbursement under Title XVIII of the Social Security Act, 79 Stat. 291, as amended, 24 42 U.S.C. § 1395 et seq., commonly known as the Medicare Act.
