For the reasons described below, the undersigned recommends that defendants’ motion be 20 granted except as to their request for summary adjudication of punitive damages. 21 BACKGROUND 22 I. Second Amended Complaint 23 The case proceeds on plaintiff’s second amended complaint (“SAC”) filed on November 24 7, 2022. (ECF No. 20.)
