Plaintiff seeks relief pursuant to 18 42 U.S.C. § 1983 and requested leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. 19 This proceeding was referred to this Court by Local Rule 302 pursuant to 28 U.S.C. § 636(b)(1). 20 Because the Court finds plaintiff’s complaint should be dismissed as frivolous, without leave to 21 amend, the Court also recommends that plaintiff’s request to proceed in forma pauperis should be 22 denied. 23 I. SCREENING STANDARDS 24 The court is required to screen complaints brought by prisoners seeking relief against a 25 governmental entity or officer or employee of a governmental entity. 28 U.S.C. § 1915A(a).
