BACKGROUND

On November 5, 2010, Alameda County Social Services Agency (Agency) filed an original petition pursuant to Welfare and Institutions Code1 section 300, alleging mother failed to protect her male child, Jesse Y. (minor), born in October 2010. The detention report states the minor tested positive for cocaine and oxycodine at birth, and is being treated with morphine for withdrawal symptoms. Mother admitted using cocaine, has a history of drug abuse and failed to complete a prior drug treatment program. At the detention hearing, the court found removal necessary and vested temporary placement and care of minor with the Agency. The Agency‘s jurisdiction/disposition report dated November 22, 2010, states minor remains hospitalized in the Neonatal Intensive Care (NIC) unit on a low dose of morphine.
