It is ordered that the opinion filed April 23, 2025, be modified as

follows:

On page 26, second sentence, under the disposition section, delete the

following:

“Plaintiff shall recover his costs incurred on appeal.”

And in its place insert the following:

“Plaintiff shall recover his costs incurred on the appeal filed by

FemtoMetrix, Rubin, and Raphael. Rolfes and Larzelere shall recover their

costs incurred on plaintiff’s cross-appeal.” There is no change in the judgment.

The petition filed by defendants Tom Rolfes and Brian Larzelere for

limited rehearing is DENIED.
