Plaintiff is proceeding pro se in this action, which is referred to the magistrate judge pursuant to Local Rule 302(c)(21) and 28 U.S.C. § 636(b)(1). Plaintiff has failed to file a first amended complaint as directed by the Court (ECF No. 31) and has failed to respond to the Court’s Order to Show Cause (ECF No. 32). Accordingly, the Court recommends this action be dismissed for failure to prosecute. I. Background and Procedural History Plaintiff filed this action on October 3, 2023. ECF No. 1. Defendant Chase Bank (“Chase”) filed a motion to dismiss on October 30, 2023. ECF No. 6. The motion to dismiss was taken under submission by Magistrate Judge Barnes on December 12, 2023. ECF No. 17.
