12 13 Pending before the Court is Defendants Pharmavite LLC and Nature Made Nutritional 14 Products’ (collectively, “Pharmavite”) motion for leave to file a motion for reconsideration. Dkt. 15 No. 56 (“Mot.”). Pharmavite moves for leave to file a motion for reconsideration of the Court’s 16 February 26, 2025 order, which denied Defendants’ motions to dismiss Plaintiff’s First Amended 17 Complaint. Dkt. No. 55 (“Order”). For the reasons discussed below, the Court DENIES 18 Defendants’ motion. 19 I. BACKGROUND 20 Plaintiff alleges that Pharmavite misled consumers by deceptively labeling several Nature 21 Made fish oil capsule products with the phrase “[h]elps support a healthy heart.” Dkt.
