13 14 In this action, plaintiff Orlando Sanchez de Tagle1 asserts one claim against defendant 15 Officer Zackery Julian of the San Jose Police Department for unlawful arrest in violation of the 16 Fourth Amendment pursuant to 42 U.S.C. § 1983. Dkt. No. 6. Mr. de Tagle seeks $30 million 17 dollars in compensatory damages and a permanent restraining order against Officer Julian. Id. All 18 parties have consented to magistrate judge jurisdiction. Dkt. Nos. 31, 33. 19 Officer Julian now moves for summary judgment on the ground that there is no genuine 20 dispute of material fact and that the undisputed facts entitle him to judgment as a matter of law. 21 Dkt.
