The Transportation Agency for 15 Monterey County (the “TAMC”) decided not to renew the Museum’s lease, then brought an 16 unlawful detainer action to evict the Museum. The TAMC asserted that it needed to evict the 17 Museum to begin construction on the SURF! Busway and Bus Rapid Transit Project (the 18 “Project”). The Museum sought a preliminary injunction.
