INTRODUCTION 21 Plaintiff Tony Lemont Sims (“Plaintiff” or “Sims”), a detainee proceeding in forma 22 pauperis and representing himself, is pursuing a civil rights action pursuant to 23 42 U.S.C. § 1983. The Court dismissed Plaintiff’s original complaint and granted him leave 24 to amend. ECF No. 6. Plaintiff has now filed a First Amended Complaint (“FAC”). ECF 25 No. 7.
