14 OFFICER B. EASON, 15 Defendant. 16 17 Plaintiff is a state prisoner proceeding pro se and in forma pauperis. Defendant’s motion 18 to modify the Court’s scheduling order is before the Court. (ECF No. 54.) As discussed below, 19 defendants’ motion is granted. 20 I. BACKGROUND 21 This action proceeds on plaintiff’s complaint alleging that defendant B. Eason was 22 deliberately indifferent to plaintiff’s safety by driving recklessly and hitting a gate, causing the 23 side of the vehicle to collide with a steel post, breaking plaintiff’s foot; plaintiff also included a 24 personal injury claim under California law. (ECF No. 1.) 25 On January 6, 2025, the Court issued the discovery and scheduling order setting the 26 discovery deadline for May 2, 2025, and the pretrial motions deadline for July 3, 2025.
