FINDINGS AND RECOMMENDATIONS 14 MOIRARA, et al., 15 Defendants. 16 17 Plaintiff, a prisoner proceeding pro se, brought this civil rights action pursuant to 18 42 U.S.C. § 1983. Pending before the Court is Plaintiff’s motion to re-open this case and for an 19 extension of time to file a first amended complaint. See ECF No. 35. Plaintiff has filed a 20 separate declaration in support of his motion. See ECF No. 36. 21 On November 8, 2024, the Court directed Plaintiff to file an amended complaint 22 within 30 days. See ECF No. 31. Plaintiff had been warned that failure to file an amended 23 complaint may result in dismissal of this action for lack of prosecution and failure to comply with 24 court rules and orders. See Local Rule 110. As of January 16, 2025, Plaintiff had not complied, 25 and the undersigned issued findings and recommendations that this action be dismissed…
