INTRODUCTION 14 Before the Court are the following four post-trial motions: 15 (1) Defendant’s Renewed Motion as a Judgment Matter of Law or New Trial (Docket No. 16 323); 17 (2) Defendant’s Motion to Compel Plaintiff to Elect a Remedy (Docket No. 324); 18 (3) Plaintiff’s Motion for Award of Prejudgment Interest Pursuant to Cal. Civil Code § 3287 19 (Docket No. 325); 20 (4) Plaintiff’s Motion for Attorney Fees and Bill of Costs Pursuant to Fed. R. Civ. P 54(d) and 21 Cal.
