ORDER 14 GENA JONES, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 18 42 U.S.C. § 1983. Plaintiff filed a motion for ninety day extension of time to file an amended 19 complaint. (ECF No. 11.) As set forth below, the pending findings and recommendations are 20 vacated, and plaintiff is granted sixty days to file an amended complaint. 21 I. BACKGROUND 22 On April 22, 2025, plaintiff’s complaint was dismissed, and plaintiff was granted thirty 23 days to file an amended complaint. (ECF No. 7.) Thirty days passed, and plaintiff did not file an 24 amended complaint or otherwise respond to the April 22, 2025 order. Based on plaintiff’s failure 25 to file an amended complaint, on June 12, 2025, the Court recommended that this action be 26 dismissed without prejudice. (ECF No. 10.)
