FOR WRIT OF HABEAS CORPUS 13 KRISTI NOEM, Secretary of the Department of Homeland Security, et al., 14 Respondents. 15 16 17 18 19 On September 16, 2025, Petitioner Minh Nhan Phan (“Petitioner”) filed a Petition 20 for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (“Petition”) challenging the 21 lawfulness of his detention by United States Immigration and Customs Enforcement 22 (“ICE”). (Doc. 1.) At the same time, Petitioner filed a Motion for Temporary Restraining 23 Order (“TRO Motion”). (Doc. 2.) The Petition and TRO Motion seek the same relief— 24 Petitioner’s release from detention.
