The Court finds these matters appropriate for disposition 16 without oral argument and the matters are deemed submitted. See Civil L.R. 7-1(b). Having 17 carefully considered the parties’ arguments, the Court (1) DENIES Defendant’s motion for 18 summary judgment, Dkt.
