18 19 I. 20 INTRODUCTION 21 On May 2, 2024, plaintiff Marvin S. filed a complaint against defendant, the 22 Commissioner of the Social Security Administration (“Commissioner”), seeking a review 23 of a denial of an application for a period of disability and disability insurance benefits 24 (“DIB”). The parties have fully briefed the issues in dispute, and the court deems the 25 matter suitable for adjudication without oral argument. 26 Plaintiff presents two disputed issues for decision: (1) whether the administrative 27 law judge (“ALJ”) properly evaluated plaintiff’s subjective testimony regarding his sleep 28 1 difficulties; and (2)…
