However, Plaintiff did not pay the filing fee when he 20 filed the complaint. Therefore, the Court ordered Plaintiff to pay the filing fee or apply to 21 proceed in forma pauperis when he filed the complaint. (Doc. 6.) After Plaintiff failed to take 22 either action, the magistrate judge found Plaintiff failed to prosecute the action and failed to obey 23 the Court’s order. (Doc. 8 at 1, 2.)
