Shields and Katinka Hosszú are professional swimmers who bring federal 16 antitrust claims and a state law tort claim against World Aquatics (formerly known as the 17 Fédération Internationale de Natation (“FINA”)), related to World Aquatics’ control over 18 international swimming competitions. After the Ninth Circuit Court of Appeals reversed this 19 Court’s grant of summary judgment in Defendant’s favor, the parties stipulated to certification of a 20 Rule 23(b)(3) damages class and thereafter reached a classwide settlement. (Dkt. Nos. 413, 420.1) 21 Plaintiffs’ unopposed motion for preliminary approval of this class action settlement is now 22 pending before the Court. (Dkt. No. 423.) Having considered the briefing and…
