ORDER 14 RAISING CANE’S USA, L.L.C., et al., 15 Defendants. 16 17 Plaintiff Elzie Bibbs originally filed the present suit in Sacramento County 18 Superior Court against his former employer, Defendant Raising Cane’s USA, L.L.C., 19 and two Raising Cane’s human resources employees, Defendants Danielle Hilton and 20 Marlene McCullah.1 Plaintiff’s list of claims was lengthy, but the core factual 21 allegations concerned events occurring after Plaintiff’s arrest on February 23, 2025. 22 Plaintiff claims that Defendants retaliated against him due to his arrest and that 23 Defendants improperly utilized his arrest as grounds to place him on unpaid leave and 24 ultimately terminate him. 25 26 1 In Plaintiff’s Complaint, Plaintiff stated that he was unaware of Defendant McCullah’s last name, 27 referring to them as “Defendant Marlene” instead.
