Defendant Ryan Scott Warner appeals from the trial court’s order denying his petition for resentencing under Penal Code section 1172.6. He contends the trial court improperly engaged in fact finding at the prima facie stage and the matter should be remanded for the trial court to decide the issue applying the correct standard of law. We conclude the record conclusively establishes Warner is ineligible for relief under section 1172.6, and we therefore affirm.
