This matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. Before the court is plaintiff’s third motion for a preliminary injunction and/or temporary restraining order and for ruling on the motion. ECF Nos. 35, 39. For the reasons stated below, the court grants the motion for ruling and recommends the motion for a preliminary injunction and/or temporary restraining order be denied. I.
