Trial Court Opinion

UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA 10 Daniel Libraty, No. 1:20-cv-01764-KJM-SAB Plaintiff, ORDER v. Douglas A. Collins, et al., IS Defendants. 16 Plaintiff Daniel Libraty, a medical doctor, received a tentative offer to work as an in- 18 house infectious disease specialist at healthcare facilities operated by the Department of Veterans Affairs in Central California. His offer was ultimately revoked. He had suffered a spontaneous 20 cerebellar hemorrhage several years before, and as a result, there was a gap in his history of clinical practice. He alleges in this case that his offer was revoked because of that gap, and he 22 claims the revocation amounted to disability discrimination in violation of federal and state law. 23 As explained in this order, nothing before the court supports the conclusion he could prove that 24 claim at trial. The defendants’ motions for summary judgment are therefore granted. !
