11 Daniel Bess brings Section 1983 claims against correctional officer J. Peffley alleging Peffley violated his First and Eighth Amendment rights when he (1) threatened to label Bess as a snitch and falsely validate him as a gang member unless he provided information on the Mexican Mafia, and (2) falsified confidential memoranda in Bess’s file after Bess threatened to file an administrative grievance. The Court previously granted in part and denied in part Defendant’s motion for summary judgment. (Dkt. No. 30.1) The Court allowed Defendant to bring a second motion for summary judgment because Plaintiff did not oppose Defendant’s request. (Dkt. No. 120.)
