16 I. Introduction Plaintiff Donte Sutton (“Plaintiff”) is a state prisoner proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. Currently before the Court is Defendant’s motion to dismiss for failure to prosecute under Federal Rules of Civil Procedure 37 and 41(b); or, in the alternative, to compel Plaintiff to respond to Defendant’s discovery requests and order Defendant’s Request for Admissions deemed submitted.
