RIOS, et al., 15 Defendants. 16 17 Plaintiff, a pretrial detainee, proceeds pro se and in forma pauperis with an action filed 18 pursuant to 42 U.S.C. § 1983. By order filed September 30, 2025, plaintiff’s complaint was 19 dismissed with leave to file an amended complaint. Plaintiff has now filed a first amended 20 complaint. 21 I. PLAINTIFF’S ALLEGATIONS 22 In his first amended complaint, plaintiff alleges the following. On or about June 2, 2025, 23 while plaintiff was housed in the west facility of the Stanislaus County Public Safety Center, 24 defendants D. Rios, J. Perez, Ruiz, #624, A. Guttierrez, and H. Delgadillo, all Stanislaus County 25 Sheriff’s Deputies, used excessive force against plaintiff in violation of his Fourteenth 26 Amendment rights. (ECF No. 8.) Following officers’ searches of other cells, plaintiff was asked 27 to exit his cell. (Id. at 5.) Plaintiff exited,…
