EDWARD BORLA, Respondent. 16 Petitioner Harpreet Singh, represented by counsel, seeks a writ of habeas corpus under 28 U.S.C. § 2254. ECF No. 1. He brings a single claim of instructional error, alleging that the trial court erred when it failed to sua sponte instruct the jury on an essential element of the crime with which he was charged. Id. at 9. Respondent has filed an answer, ECF No. 11, arguing that the claim should be denied, and petitioner has filed a traverse, ECF No. 12. Petitioner has also filed a motion for prompt issuance of findings and recommendations. ECF No. 13. After reviewing the pleadings, I recommend that petitioner’s claim be denied. In light of the issuance of these findings and recommendations, I deny petitioner’s motion for prompt issuance of the same. 25 26 27 28 …
